  • Thirty days must have passed since the death of the decedent.
  • Affidavit must be filed with the probate division clerk of the local circuit court where the decedent resided at the time of death.

How to Write a Missouri Small Estate Affidavit Form

Start the affidavit by writing in the county, the decedent’s full name and social security number at the top of the document. Fill in the affiant’s name and address and then enter the decedent’s name, address, date of death and county in Section 1. In Section 2, circle A if the decedent left a will and circle B if the decedent passed away intestate, or without a will.

In Section 4, attach an itemized list of all the personal property to be collected along with an appraisal. In Section 5, attach a legal description and appraisal of all real estate to be collected. Finally, attach a list of all the heirs, addresses and relationship to the decedent.
