Thirty days must have passed since the decedent passed away.
Affidavit must be filed with the local county court clerk where the decedent resided at the time of death.

How to Write a Mississippi Small Estate Affidavit Form

Start the affidavit by entering the names of the heirs of the decedent at the top of the form. In Section 1, write the name, social security number, date of death, county and age of the decedent. Make sure to attach a copy of the death certificate and label it as Exhibit A. In Section 2, write in the decedent’s address in Mississippi at the time of death.
