  • Forty-five days must have elapsed since the death of the decedent.

  • Must be filed in the local probate court where the decedent resided at the time of death.

How to Write an Indiana Small Estate Affidavit Form

Start the affidavit by filling in the decedent’s information at the top of the document. This includes the decedent’s name, social security number, date of death and the place of residence at the time of death. Below this, write in the affiant’s name and make sure the estate is valued at less than $50,000 and at least 45 days have elapsed since the decedent passed away.

Next, fill in or attach a list of all the heirs, the corresponding percentages of the estate each heir is entitled and the address of each of the heirs. The affiant will then sign and date the affidavit along with their social security number, date of birth and full address.
