To qualify as a small estate in Oregon, the estate in question must be valued at less than $275,000. Of the $275,000 Oregon small estate limit, no more than $200,000 of real estate and up to $75,000 worth of personal property can be collected with the small estate affidavit.

  • The decedent must be a resident of the State of Oregon.

  • The estate in question must be valued at less than $275,000. Not more than $75,000 in personal property and less than $200,000 in real estate.
  • Thirty days have elapsed since the death of the decedent.
  • Must be filed in the local probate court where the decedent resided.

How to Write an Oregon Small Estate Affidavit Form

Start the affidavit by writing the name of the person who died at the top of the form. Enter the affiant’s name and address in the first section of the document and check the box or boxes that apply to the decedent’s estate. In Section 2, fill in all the pertinent information concerning the decedent, including the decedent’s name and address, social security number, the affiant’s relationship to the decedent and the date the decedent passed away.

Attach an itemized list of the real and personal property to be collected with values of each and a certified copy of the death certificate to the affidavit. Make sure thirty days have elapsed since the decedent’s passing before getting the affidavit notarized.
