A Nevada small estate affidavit form is used under circumstances where the decedent has a limited amount of assets. To qualify for a small estate in Nevada, the estate in question must be valued at less than $25,000. However, if the successor is the spouse of the decedent, the small estate limit is raised to $100,000.
Nevada Small Estate Affidavit Requirements
- The decedent must be a resident of the State of Nevada.
- Falls under Nevada Revised Statues 146.080 – Estates not exceeding certain amounts: Transfer of assets without issuance of letters of administration or probate of will; affidavit showing right to assets.
- The estate in question must be valued at less than $25,000 for heirs; $100,000 for spouse.
- Forty days have elapsed since the decedent passed away.
- Must be filed in the local county probate court the decedent resided in at the time of death.
How to Write a Nevada Small Estate Affidavit Form
Start the affidavit by filling in the county and the affiant’s name. Then, write the decedent’s name, date of death and address at the time of death. Attach an itemized list of all the personal property to be collected along with the names of each successor and the share of the estate in a percentage that each heir is to receive.
In Section 11, state if probate proceedings have taken place, pending or not taking place. For Section 12, circle yes or no if the decedent left a will at the time of death. If the decedent did not leave a will, Form UP-40 Nevada Affidavit of Heirship, must also be completed and attached to the Nevada Small Estate Affidavit. Make sure to attach a certified copy of the death certificate, also.
